Shep Smith Is Not Happy That The Texting Into Fountain Lady May Sue The Mall

Earlier today we reported on Cathy Cruz Marrero, America’s latest viral video since golden voiced Ted Williams, who is considering her legal options after footage of her falling into a shopping mall fountain while texting hit it big on YouTube. This afternoon, Fox News’ Shepard Smith had on a panel to discuss the legal ramifications of her case, and good ole Shep (who at one point exclaimed “let me tell you about some YouTube sir!) could not resist calling out the absurdity of the case.

The trial attorney on hand took the position that Ms. Marrero’s case is centered around the Mall security staff who ostensibly published the damning (and hilarious) clip on YouTube, to which Shep exclaimed “well too bad! You’re in a public place where you know cameras are going to be and you can end up on YouTube!” before suggesting that we laud this woman for providing the cautionary tale.

    You are all a bunch of morons. The liability is not her falling into the fountain. It is the security company sending the tape to You Tube. How would you like it that if you are walking in the mall and the next thing you know a video of you picking your nose or scratching your ass or you arguing with your spouse about how much she spent on shoes airs on You Tube because some rent a cop decides it’s funny. Just because you are in a mall doesn’t mean rthe mall has the right to spy on you and reveal it to the world. Security cameras are for security, not amusement.

    He was defending her case?? I didn’t hear anything he said. All I could think about when he was talking is “why in the hell would they put on a cross-eyed Lawyer?” I mean seriously.. am I the only one?? I will have to go back and replay the video and close my eyes and just listen and then repost. dayyyummm

    Welcome to the 21st Century. Everything is on video and video finds its way to You Tube. That is a fact of life. And if she’s so embarrassed about it, what’s she doing on Good Morning America identifying herself to the planet?

    A couple non-partisan notes:

    1. The guy on the left of the screen is awesomely cross-eyed.

    2. If this girl was really that embarrassed or upset about this whole thing, she should know a lawsuit is the worst thing she could do. All a lawsuit does is make this a story so news networks can play it ten times a day and we can laugh at it ten times a day

    It is not hard to understand why Fox News people have a distorted view of politics. After watching Megan Kelly and her cohort accomplices describing the accident or negligence relating to the lady who fell into the pond in the middle of the shopping center while text messaging on her phone. If someone falls on their butt, sometimes it is a normal reaction to laugh, but it is also a human reaction to control ones emotion and show sympathy by restraining the emotional laughter and offering to help the person. This person could have been a person with bad vision, using a white cane or a mentally challenged person not paying attention as they should have been. People who are quick to criticize and make laughter over everyone’s misfortune are ignorant and have no finesse and have insufficient character.
    My appraisal of this situation is; she made a mistake and thank God she was not driving a car while she was text messaging. I also believe the people who own the pond should put a hand rail about 3 or 4 feet high around the pond to protect people who are mentally challenged, people who have bad eye sight who are sometime walking with a cane or people who have children who maybe be horsing around could cause an elderly person to be bumped over the curb into the pond. People today in business understand Murphy’s Law, that is why they have faucets that turn themselves off and bathroom fixtures flush themselves. We are all negligent at one time or another. Busy people on the go make more mistakes than someone sitting in the same position for a prolong period of time

    I heard on an interview with the doofus herself, that she WORKS IN THE MALL (so to say that she DIDN’T KNOW that the fountain was there is flat out WRONG).

    She was, simply, CARELESS, and I don’t see how the Mall is responsible for HER carelessness.

    Likewise, if she tries to assert some sort of “damage” over her public embarassment – her IDENTITY is NOT KNOW (until SHE comes forward and makes herself a part of the story). Had SHE remained silent, this would have been NOTHING MORE than an UNKNOWN PERSON falling into a fountain while texting – her IDENTITY would be UNKNOWN (expect, possibly, by her “friends”).

    Let us NOT forget that this was a PUBLIC PLACE, where there’s NO “expectation of privacy”. Had all her friends been with her, when she fell into the fountain (and, I ASSUME they still would have laughed [because, let's face it - IT'S FUNNY]), would she STILL insist on blaming THE MALL (for her embarassment)?

    I hope the judge LAUGHS at her lawsuit!

    I couldn’t agree more Shep! She’s an airhead, and if the public
    has a right to know when it comes to the wiki-leaks then we have
    a right to see this. Especially since this could be considered a
    public service announcement. An instructional on why you need
    to keep your head out of your butt.

    So if I, as Random Joe Citizen, were in the mall that day and I had my cameraphone out to video something at the time, and just by coincidence caught this woman falling into the fountain… she could sue me if I upload it to YouTube?

    Or are the standards different because I’m just an ordinary citizen as opposed to a member of the security company?

    She has a record. It’s obvious she purposely identified herself so that she could then attempt to sue the Mall for allowing her accident to be sent to youtube.
